Purpose and acceptance

These terms govern the use of kalyneo.com, published by Julien Rozelier, whose details appear in the legal notice.

Browsing the site constitutes acceptance of these terms. If you do not agree to them, you need only refrain from using it. Access to the site is free and requires neither registration nor purchase: no sum is ever claimed from you.

Description of the service

Kalyneo is a comparison service. It collects prices from third-party merchants, publishes quality assessments produced by its editorial team, and sends visitors on to the site of the merchant they choose.

Kalyneo is neither a seller, nor a sales intermediary, nor the agent of any merchant. We take no payment, ship no product and provide no after-sales service. The sales contract is formed solely between you and the merchant, on that merchant’s terms. It is with the merchant that the right of withdrawal, the legal warranty of conformity, the warranty against hidden defects and any complaint about an order, a delivery or a refund must be taken up.

Access to the site

The site is available continuously, subject to interruptions required for maintenance, to technical incidents and to cases of force majeure. The publisher takes reasonable steps to keep it available, without being bound by an obligation of result.

Connection charges and the equipment needed for access remain at your expense.

Account and price alerts

Browsing the site requires no account. An account is needed only to keep a watchlist from one device to another and to receive price alerts.

Signing in works without a password: a one-time code is sent to the email address you give. That code is valid for ten minutes and its use is limited to three attempts. Keeping access to your inbox is your responsibility, since it is the inbox that controls access to the account. You undertake to provide an email address that is accurate and yours.

A price alert is a notification sent when a threshold you have set is reached. It goes out within a reasonable time after the reading, with no guarantee that the offer is still available when it arrives: a price may go back up, or a product become unavailable, between the sending and your reading it. Every message carries an immediate unsubscribe link.

You may ask for your account to be deleted at any time. Deletion carries with it the deletion of your watchlist and of your alerts.

Prohibited uses

In using the site, you undertake not to:

• extract, copy or systematically reuse all or a substantial part of the content of the site, in particular by automated scraping, including in order to build a database or train an automated model;
• disrupt the working of the site or its servers, in particular through an abnormal volume of requests, or circumvent a technical protection measure;
• generate artificial departures towards merchants, or attempt to distort the counting of clicks or the attribution of commissions;
• impersonate a third party, in particular by creating an account with an email address that is not yours;
• use the site for an unlawful purpose, or in a way that infringes the rights of others.

Normal crawling of the site by a search engine that respects the robots.txt file is not covered by these prohibitions.

Site content

The texts, criteria grids, assessments, rankings, graphic elements and structure of the site are protected. Reproducing or reusing them requires prior written permission, under the conditions set out in detail in the legal notice.

Short quotations from our analyses remain permitted under the conditions laid down by law, provided that Kalyneo is named and that a link points back to the original page.

The specifications, images and trademarks of the products compared belong to their respective owners and are reproduced for identification purposes only.

Links to third-party sites

The site contains links to merchants’ sites. Those links are affiliate links, disclosed as such. The sites they lead to are run by independent third parties: their content, their terms of sale, their actual prices and their personal-data practices are a matter for their operators alone, and it is for you to read them before any purchase.

Prices, availability and absence of warranty

The prices, availability and specifications shown are information collected automatically, time-stamped, and liable to have changed since. They are given for guidance. Only the information displayed by the merchant when the order is placed is binding.

The prices shown are to be understood under the conditions set out on the Our method page, which states in particular what they include and what they do not.

The assessments published are the expression of a methodical judgement, not a warranty of performance. They do not bind manufacturers and are no substitute for any testing you might wish to carry out yourself.

Liability

The publisher cannot be held liable for the consequences of a purchasing decision based on collected information that proves wrong or out of date, nor for the performance of an order placed with a merchant, nor for the temporary unavailability of the site, nor for damage arising from the use of a third-party site reached from our pages.

These limitations do not apply in the event of intentional or gross fault by the publisher, nor in cases where the law sets them aside. They do not affect the rights you hold, as a consumer, under mandatory provisions.

Personal data

The processing of your data is described in the privacy policy, and the trackers placed in your browser in the cookie policy. Those two documents form an integral part of these terms.

Changes to the service and to these terms

The publisher may develop the site, its features and its comparison method. A change in the method is reflected on the Our method page, whose update date is published.

These terms may be amended. The applicable version is the one published on this page at the time of your visit; the date of the last update appears under its title. A substantial change affecting account holders is notified to them by email.

Term, suspension and termination

These terms apply throughout your use of the site. You may stop using it at any time, and ask for your account to be deleted where applicable.

The publisher may suspend or delete an account in the event of a clear breach of the prohibited uses listed above, after a warning where circumstances allow. That measure is without prejudice to remedies under the general law.

Governing law and disputes

These terms are governed by French law. Should one clause be declared void, the others would continue to apply.

In the event of difficulty, write first to no-reply@kalyneo.com: most disagreements are settled that way. Failing an amicable settlement, the dispute falls to the courts having jurisdiction. If you are a consumer resident in the European Union, you keep the option of applying to the courts of your place of residence, and the benefit of the mandatory provisions of the law of your country.
